Terms of Use
Last updated: 22 September 2026
Important — read these terms before installing or using MailNox. By installing, accessing, or using the Software or Site, you agree to this Agreement. If you do not agree, do not install or use MailNox.
1. Definitions
- Customer means the individual or organisation entering into this Agreement.
- MailNox, we, or us means Thetawave Technologies, the owner and licensor of the MailNox Services.
- Software means the MailNox desktop application and related components we make available in object-code form, including updates we provide.
- Site means https://mailnox.app and related web properties we operate, including the account and licensing portal.
- Services means the Software, Site, and any associated account, licensing, update, or support services we provide.
- Device means one compatible hardware device on which the Software is installed and activated.
- Documentation means user guides and materials we publish for the Software.
- Licence means the limited right to use the Software under the plan you purchase or are granted (trial, personal, business, or other plan we publish).
2. Licence grant
Subject to this Agreement and timely payment where required, Thetawave Technologies grants you a non-exclusive, non-transferable, territorially unrestricted licence to install and use the Software on the number of Devices allowed by your Licence plan, solely for your internal purposes as permitted by that plan. Nothing in this Agreement entitles you to source code. The Software is proprietary and is licensed, not sold.
Licence types, device limits, feature scope, and pricing are described on the Pricing page and in your account portal, and may change for future purchases. Only one active Licence entitlement may apply to a Device at a time unless we expressly allow otherwise.
3. Licence restrictions
Except as permitted by mandatory law, you may not:
- copy, modify, distribute, sell, rent, lease, or sublicense the Software;
- reverse engineer, decompile, or disassemble the Software;
- circumvent licence, device-slot, activation, or security controls;
- remove proprietary notices from the Software or Documentation;
- use the Software to provide a hosted email service to third parties;
- use the Services unlawfully, including to send spam or malware;
- misrepresent that MailNox certifies or guarantees your business or content.
4. Accounts, activation, and updates
You are responsible for account credentials and for activity under your account. Device activation may require network connectivity to our licensing services. First launch may work offline for a limited period; registration and ongoing entitlement checks complete when connectivity is available, as described in product documentation.
We may provide updates, patches, or new major versions. Some updates may be required for security or continued access to online Services. Entitlement to future major versions depends on your plan.
5. Email providers and your content
MailNox is an email client and workspace, not a mailbox host. You keep your existing provider accounts. You are solely responsible for complying with your email provider's terms, applicable law, and the content of messages you send or store.
Mail and workspace data downloaded by the Software generally remain on your Device. Uninstalling MailNox does not delete mail stored with your provider. You are responsible for backups of local data you care about.
6. Optional third-party and AI services
Optional integrations (providers, calendars, cloud AI, payment processors) are subject to those parties' terms. MailNox is not responsible for third-party services you choose to enable. Local intelligence features do not grant you rights to third-party models beyond their licences.
7. Fees and refunds
Paid Licences are charged according to the price list and checkout flow at purchase. Except where required by law or expressly stated at purchase, fees are non-refundable once a Licence is delivered or activated. Taxes may apply.
8. Intellectual property
The Software, Site, branding, and Documentation are owned by MailNox and its licensors and are protected by intellectual property laws. This Agreement does not transfer ownership. Feedback you provide may be used by MailNox without obligation to you.
9. Privacy
Personal data is handled as described in our Privacy Policy. By using the Services you also acknowledge that Policy.
10. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with every provider configuration.
11. Limitation of liability
To the maximum extent permitted by law, MailNox and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from the Services or this Agreement, even if advised of the possibility. Our aggregate liability for claims relating to the Services is limited to the greater of (a) the amounts you paid us for the Licence giving rise to the claim in the twelve (12) months before the claim, or (b) fifty US dollars (US $50), except where liability cannot be limited by law.
12. Indemnity
You will defend and indemnify MailNox against claims arising from your misuse of the Services, your content, or your violation of this Agreement or applicable law, except to the extent caused by our wilful misconduct.
13. Suspension and termination
We may suspend or terminate access for material breach, non-payment, fraud, or legal risk. You may stop using the Software and close your account as available in the portal. On termination, your licence to use the Software ends and you must cease use and destroy copies, except copies you must retain by law. Sections that by nature should survive will survive termination.
14. Changes
We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance of the revised Terms, except where mandatory law requires a different process for material changes.
15. General
This Agreement is the entire agreement between you and Thetawave Technologies regarding the Services and supersedes prior conflicting terms for that subject. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign this Agreement without our consent; we may assign it in connection with a corporate transaction. Governing law and venue will be determined by the jurisdiction in which Thetawave Technologies is organised, except where mandatory consumer protections apply in your country of residence.
